Use of the services of lol.travel implies the acceptance on the part of the consumer of these terms and conditions, of the general sales contract conditions for all tourism services which are available at the bottom of these terms and conditions.
Without prejudice to the cases provided for in articles artt. 32 - 51novies of the Tourism Code (Legislative Decree 21 May 2018, no. 62 implementing the (EU) Directive 2015/2302 on tour packages and linked tourism services) lol.travel informs the consumer that they exclusively carry out the sales activity for all services offered we invite you to carefully read the GENERAL CONDITIONS (especially articles 1 and 3) of this site as applicable.

This touristic service cannot be regarded as a negotiation case in point for the organisation of tour packages and is therefore governed by the terms and conditions of the single service object of the contract as found below, the consumer is invited to carefully consult the passenger and baggage transport conditions of the selected airline.

CONTENTS AND USAGE OF lol.travel SITE

Booking and purchase of products and services on the site lol.travel is governed by the contractual conditions applied by these same products and services. Each user is required to know and accept the conditions of use of the site before proceeding with the booking and/or purchase.

The collection, processing and any other operation relating to information conferred during the booking process is carried out in accordance with the Privacy Policy; the consumer undertakes to use the services and functionality of lol.travel, and it's services only for lawful purposes, in compliance with the general conditions of the contract of sale of touristic packages and the contractual conditions that regulate the provision of services.

LIMITATION OF LIABILITY

Neither lol.travel nor any of its subsidiaries acknowledge any guarantees, express or implied, or assume any legal responsibility for the accuracy or completeness of the photos, descriptions, and other information regarding hotels on the website as these are provided by third parties.

It is also forbidden to use this site for any illegal or prohibited purpose. These conditions may be changed by lol.travel at any time.

PAYMENTS

Where required by the national legislation of some countries (by way of example but not limited to: Argentina / ARS currency), you may be charged for government taxes related to your country and currency, and such charges, if any, are beyond the control of lol.travel.



  • lol.travel advises the consumer that it acts exclusively as an intermediary for all the services offered. The provision of a scheduled flight cannot be construed as the organisation of a tourist package and as such it is disciplined by the terms and conditions for a single service as evidenced below. We recommend that you study carefully the conditions of passenger and baggage transport of the airline selected.

    lol.travel acts exclusively as an intermediary for products and/or services.

    The booking and/or combination of flights and of different products and/or services provided by lol.travel is entirely at the client's discretion, who as such assumes every responsibility arising from the combination of said services.

    lol.travel is in no way responsible for the incorrect insertion of users' personal details during the booking process. The user is, therefore, responsible for the consequences arising from mistakes of insertion. Specifically relating to FLIGHTS, lol.travel acts simply as an intermediary for the airlines in the sale of flight tickets. The price is not confirmed until the emission of the flight ticket. lol.travel is in no way responsible for the obligations imposed on the suppliers of the individual products and/or services, but is responsible exclusively for those arising out of its role as an intermediary and in any case within the limits set by the law and regulation of articles no. 1, n. 3 and n. 6, from 17 to 23, from 24 to 31 of Law 27/12/1977 no. 1084 ratified and implemented by the international convention relating to travel (CCV) signed in Brussels on 23.4.1970 (limited to those parts of the provisions which do not refer to the contract for the sale of tourist packages and up to its repeal by Art. 3 of the Law 79 of 23 May 2011 - Code of Tourism) and by arts. 51, II comma, 62 and 65 of the Law 21 February 2014, n. 21 Activating the directive 2011/83/UE on consumer rights, limited to the service of passenger transport.

    lol.travel, as the intermediary, is not responsible for the partial or total cancellatoin of journeys, stays or other products and/or services which are part of the contract concluded between the passenger and the supplier of the relevant products and/or services. Clients declare and guarantee to indemnify lol.travel, as well as subjects linked to and controlled by it, its representatives, employees, collaborators as well as its partners from any claims for damages, including legal costs, that may arise against them in relation to the use of products and/or services acquired in this section of the site. The baggage allowance is never guaranteed by lol.travel and must be checked directly with the airline, which can, at its discretion not include it in the price of the ticket. In this case it is necessary to check directly with the carrier what to do in order to be able to load hold baggage. Authorisation and indications depend upon the airline. Pursuant to the law, clients indemnify lol.travel for eventual delays, damages or losses linked to transportation, cancellation of flights or other inconveniences attributable to the airlines' responsibility, also pursuant to the Regulation 261/04/EC which establishes common rules in the matter of compensation and assistance for passengers in the event that boarding is refused, of cancellation of the flight and of extended delays. Flight segments must be used consecutively, the non-use of any of this segment can determine the automatic cancellation of the travel itinerary.

    Power to request documentation by lol.travel

    lol.travel reserves the right to request the necessary documentation that confirms the identity of the subject who has made the reservation, the owner of the credit card, as well as the beneficiaries of the services acquired. The documentation will be requested within travel start date with lol.travel and could be done by phone and/or email. In the case the information and documentation is not provided by the interested parties within travel start date with lol.travel, Easy Market will have the right to cancel the reservation, applying a penalty equivalent to 100% of the value of the reservation.

    Payment Methods

    It is possible to purchase a scheduled flight on lol.travel with the following credit cards: American Express, Diners, Visa, Mastercard and all the prepaid cards which are part of the Visa Electron circuit as long as they are enabled for online payment. Credit card payments are in line with the high security standards guaranteed by SSL (secure socket language) cryptographic technology. An automatic anti-fraud system intervenes in every transaction to intercept any frauds and to protect our systems. In the event that a valid reservation is mistakenly blocked by the anti-fraud system, passengers will be advised that the booking was not finalised and our customer services will provide alternative solutions in order to finalise payment. In these cases lol.travel cannot guarantee that that the price will remain the same nor that the reservatoin will not be cancelled by the airline.
    The total price of the reservation includes, in addition to the final flight price, the services selected by the customer and management fees. Management fees are always showed before the payment and they are non-refundable by lol.travel to the customer. The amount charged corresponds exactly with the total price of the reservation and is accepted by the customer at the end of the booking process.

    Information present on lol.travel

    The intermediary undertakes to take every reasonable care to ensure that the information contained in the site and relating to the services offered are accurate and up to date. However, the information contained in the site is provided by third parties. As such, within the limits established by the applicable law the intermediary cannot be held responsible for their accuracy.

    Travel documents

    It is the consumer's responsibility to ensure that he/she has the identity documents, visas, sanitary requirements valid and necessary to enter the countries covered by the itinerary, it is his/her exclusive responsibility to respect all of the laws and regulations of the departure, transit and arrival nations. lol.travel declines any responsibility for problems arising from a consumer's failure to respect any of these requirements.
    At the time of check-in, the carrier may request the entry of the passport details; the passport must be produced also at the departure airport.
    During the booking phase it is particularly important to pay attention when completing the fields relating to names and surnames, which must correspond exactly with those on identity documents.

    The carrier can only accept and board the passenger whose name is printed on the ticket.

    There is no right to any refund in the event that boarding is denied for failure to present the required documents or for having invalid documentation. The passenger has sole responsibility for possession of the required documentation.

    For information on the documents requested for entry into individual countries we suggest that you consult the website of the Ministry of Foreign Affairs prior to purchase.

    Ticket collection, check in and boarding

    For ticket collection and check in formalities passengers should present thmselves directly at the relevant desks in the airport with their identity document valid for boarding. It is advisable to go to check in at least 2.5 hours prior to the departure of the flight to finalise check in procedures. For passengers transiting in or travelling to the United States we strongly suggest arriving at check in at least 3 hours prior to the flight departure. The reservation shows the departure time of the flight. In the event that a passenger does not arrive in time at the check in desk or at the boarding gate, or is not in possession of the correct documentation or is denied travel, the airline will not be able to accept or board the passenger and will not be able to delay departurelol.travel declines any responsibility relating to the above since the sole responsibility for damages and costs arising out of a failure to respect the above requirements lies with the passenger.

    Electronic ticket (e-ticket)

    An electronic ticket is sent automatically to the airline/carrier and is identified by a booking code called PNR (Passenger Name Record) which is communicated at the moment the booking is confirmed in a confirmation email sent to the email address indicated by the client during the booking process. We remind you that flight tickets are valid for a year from the date of issue. The expiration of this period makes it impossible to use the ticket and/or to apply to it any type of variation and/or refund.

    Seat assignment (optional service)

    In case you choosed our seat assigment service, our Customer Care will manage it in accordance to your request, if possible and seats are available. If the airline will apply an extra cost, our team will inform you about the price before proceeding and you will be able to decide if you want to go ahead or not. Our seat assigment service is not refundable.

    Meal selection on board (optional service)

    If you have contracted the on-board meal selection service, once you have completed your booking, your request will be forwarded to the airline.
    Please note that the following provisions apply:
    • - Availability of the selected meal may not be guaranteed and alternatives may vary depending on the airline.
    • - Special meal requests are only made for flights where meals are offered on board; for short duration flights (less than 4 hours), meals are not normally included.
    • - The service charge refers to an administrative fee charged by the travel agency.

    Business or Premium class selection

    Your choice of Business, or First or Premium Economy cabin may not guarantee the required service coverage for all intermediate routes.

    SMS booking number (optional service)

    If you have purchased our service, we will send you an SMS with your booking number directly to the phone number registered at the time of booking and you can enjoy the convenience of travelling offline. No information regarding flight updates and/or delays will follow. Please note that lol.travel will not be held liable in any way in the event of inefficiency on the part of the telephone company. If you have not already purchased the service and wish to add it, request the service from your reserved area. The service is non-refundable. Attention: by entering an incorrect or incomplete telephone number we will not be able to guarantee the correct reception of the message: therefore, please check carefully that the telephone number entered in order to take advantage of the optional service "booking number by SMS" is correct and complete. For this reason, lol.travel does not accept any responsibility for the non-receipt of the message in the event that the customer provides us with an incorrect or incomplete number.

    Changes and Cancellations

    Tickets are non-transferable. For this reason name changes are never allowed. Please ensure, therefore, that names are inserted correctly during the booking process and are exactly as indicated on your ID document or passport.
    A penalty fee set by the airline and/or service supplier according to its published policy is applicable for any change of date or route after a ticket has been issuedl. This may vary according to when a variation is requested. This fee is in addition to any possible supplement to revised ticket price. All requests for changes must be sent via e-mail to flights@lol.travel .Once your request has been received, we will check whether changes are allowed with the ticket you have purchased. If changes are permitted we will advise you via e-mail of the total fees applied by the airline and wait for your acceptance via e-mail before actioning any changes. In addition to these penalties, an agency fee of €55,00 per booking will be charged for each change. If during the booking process you have purchased the "Premium Assistance" service package, you do not have to pay lol.travel agency fee, but only the penalty penalty fee set by the airline.

    In case insurance is included in your reservation, the amount considered by Filo Diretto will be the one on your confirmation email. If you change your ticket, the insured amount will not change unless you will require it at time of modification.

    Refunds

    All cancellation requests must be communicated via e-mail to the following address: flights@lol.travel
    We would advise that many ticket prices are subject to cancellation fees and in some cases tickets are non-refundable. The airline and/or supplier are responsible for the authorisation of any refunds and for the time taken for these to be made. Once we have recevied your request, we will advise you via e-mail of the fees applicable by the airline and will await your acceptance via e-mail before proceeding to cancel your ticket and to request a refund. In addition to these penalties, an agency fee of €55,00 per booking will be charged for each cancellation or refund request.
    If payment was by credit card the amount will be credited directly to the credit card used to make the booking. We would clarify that the agency fees and any insurance policy are never refundable.

    Unaccompanied minors

    Passengers under 18 years may not be boarded if not accompanied by both parents.

    After sale

    lol.travel reserves the right to retain adequate management costs up to a maximum of € 55.00 (as required by the mandate ratio established between lol.travel intermediary agency and the end customer, articles 1719 and 1720 cc) for the following purposes in the after -sales phase and at the request of the end customer: involuntary changes, voluntary reimbursements, involuntary reimbursements, refund and use voucher provided by the airlines pursuant to Art88bis of the "Cura Italia" decree.

    Check-in online

    PLEASE NOTE:
    Some low cost carriers offer compulsory online check-in to be done on their own website within a published timeframe prior to departure. Passengers who do not present a printed boarding card to airport security personnel and at the boarding gate will have to check in again at the check in desk (if that is possible) and will have to pay a supplement imposed by the airline. The carries which currently require compulsory online check in include but are not limited to: Ryanair, Volotea, Wizz Air e Bluair.

    Emission of tickets

    Generally low cost airlines use electronic tickets. This means that no paper ticket will be printed. Once your booking is finalised you will be sent a confirmation email where the booking reference for your low cost flight will be highlighted. We ask you to print it and to present it together with your identity document assieme at check in. We would advise that for all Ryanair air flights it is compulsory to check in online on the site of Ryanair and to print the boarding card to present in the airport. To this end we would ask you to take careful note on their website of the time limits within which it is compulsory to print the boarding card, since a penality is applied by the airline in the event that the time limit is not respected.

    Ticket payment

    The charge of the cost of your flight will be carried out by Easy Market SpA, the company that owns lol.travel.

    Cancellations

    In general tickets issued by low cost airlines are non-refundable except in those cases when the airline cancels or changes sifnificantly. For further details we would ask that you consult the terms and conditions of the specific carrier. It is advisable for passengers who book far in advance to reconfirm their reservation 24 to 72 hours prior to departure, checking directly on the website of the selected airline.

    Name changes

    The possibility of the name change must be checked with the airline.

    Date, time and itinerary changes

    Date, time and itinerary changes can be changed if there is availability and following payment of a supplement for the variation, in addition to payment of the difference between the original price paid and the lowest price available at the time of the change. If the new price is less than that paid originally, no refund is envisioned. In any case changes should be requested directly to the low cost airline.

    Hold luggage

    We advise you that for some low cost airlines hold luggage is not always included in the reservation. The addition of luggage can be done via the website when possible.

    Security regulations for hand luggage

    Since 6 November 2006, the European Union has adopted new security rules which limit the quantity of liquids which can be carried through airport securify controls. Passengers can carry only small amounts (max 100 ml per container) of liquids, gel, and creams in hand luggage and they must be carried in a transparent plastic bag which cannot exceed 1 litre (with dimensions of approx 18 x 20 cm). Prescription liquids and dietary liquids such as baby food can be carried outside the plastic bag and are not subject to limitations. There are no limitations to liquids carried in hold luggage.     The booking and / or combination of hotel and the different products and / or services provided bylol.travel at the discretion of the customer, which assumes any liability arising of any combination thereof.lol.travel does not respond in any case of the erroneous inclusion of personal data carried out during the purchase process. The user is then responsible for the consequences arising from their incorrect insertion. In this case the product HOTEL,lol.travel acts as an intermediary in the sale of the hotel supplier hotel accommodation.lol.travel does not respond in any case for the obligations imposed on providers of individual products and / or services, but is responsible only for those arising from his role as intermediary and in accordance with the law in accordance with Articles. 1, n. 3 and n. 6, 17 to 23, 24 to 31 of the Law 27/12/1977 n. 1084 ratifying and implementing the International Convention on Travel Contracts (CCV) signed in Brussels on 23.4.1970. lol.travel, as a travel intermediary, is not liable for all or part of travel, accommodation or other products and / or services which are the subject of the contract between customer and supplier of related products and / or services.

    Prices - Errors in the contents of the system

    lol.travel acts as an intermediary in the provision of tourist services offered by third parties, who directly provide the relevant information and costs.lol.travel cannot guarantee the correctness and/or accuracy of the data provided by third parties for which it is in no way responsible. In the event of errors and/or inaccuracies in the data relating to the tourist service, lol.travel will immediately cancel the booking and will only be required to guarantee the refund of the cost of the cancelled booking.

    Taxes

    The hotel rates indicated on lol.travel normally include the following types of taxes: state, federal, and municipal taxes.
    Where required by the national legislation of some countries (by way of example but not limited to: Argentina / ARS currency), you may be charged for government taxes related to your country and currency, and such charges, if any, are beyond the control of lol.travel. 
    All tourist taxes and resort fees are always excluded from the cost of the booked service and must be paid on-site by customers/guests (unless otherwise expressly indicated in the policies of the booked hotel).
    All additional costs unless explicitly indicated as included in the booking price will be charged to the customer. It should be noted that in relation to duties and taxes and other taxes to be paid locally, since the relative amounts are imperatively decided by the local authority without any obligation of publicity or prior notice and are sometimes not easy to obtain, lol.travel, despite carrying out continuous and periodic checks with the suppliers of the accommodation facilities, cannot be held liable in the event of a sudden deviation of such public charges from the time of its offer.

    Customer comments and requests:

The accommodation facility, at its own discretion and based on availability, reserves the right to accept or refuse the customer's request.
    Furthermore, customer requests that require written reconfirmation (by way of example, but not limited to: rooms for the disabled, accompanying animals, confirmation of double bed or twin beds, cot) will be confirmed by lol.travel only with prior written notice from the service provider. lol.travel will pass on the request to the supplier and will inform the customer of any price adjustments or supplements to be paid which, in the event of a reconfirmation, will in any case remain at the sole expense of the customer.

    Changes and Cancellations

    If the customer wants to change a reservation, he must send the request through the dedicated form in the reserved area of ​​lol.travel. To access, just enter the email indicated during the purchase and the booking code (PNR). lol.travel will verify the possibility of modification, any penalties provided by the hotel supplier and any price differences and will submit them to the customer before proceeding with the modification. The cost of the service provided by lol.travel is 55.00 euros, even in the event of a change due to COVID-19.
    If the customer wants to cancel a reservation, he must proceed in self-service mode, through the reserved area of ​​lol.travel. To access, just enter the email indicated during the purchase and the booking code (PNR). The self - service activity does not provide for the payment of charges to lol.travel. Cancellation and any refunds are subject to the hotel policies, accepted by the customer during the purchase. If the customer requests the intervention of lol.travel, the cost of the service is 55.00 euros, even in case of cancellations due to COVID-19.

    Refunds

    If the payment was made by credit card, the amount will be refunded directly to the credit card used to place the order. The amount will be available to the statement 2/3 months of the request, depending on the circuit of payment used.     • 1. SUBJECT MATTER
      With this ADDENDUM, Easy Market Spa complies with Regulation (EU) 2022/2065 (hereinafter the "Regulation") which establishes due diligence obligations for providers of intermediary services as regards the way they should combat illegal content, online disinformation and other risks for business users and consumers. The objective of the Regulation is to ensure a safe, predictable and trustworthy online environment, combating the spread of illegal content online and the risks for business users and consumers that the spread of disinformation or other content can generate. Easy Market Spa applies Regulation (EU) 2022/2065 as a provider of intermediary services with place of establishment or location in the European Union.

    • 2. ILLEGAL CONTENT
      Illegal content is any information, regardless of its form, which under applicable law is in itself illegal, such as illegal hate speech or illegal terrorist content and illegal discriminatory content, or which the applicable rules make illegal in consideration of the fact that they concern illegal activities. These include but are not limited to, the sharing of images depicting child sexual abuse, the unlawful non-consensual sharing of private images, cyberstalking, the sale of non-compliant or counterfeit products, the sale of products or the provision of services in violation of consumer protection law, the unauthorised use of copyright-protected material, the illegal offer of accommodation services or the illegal sale of live animals.

    • 3. RIGHTS OF EASY MARKET SPA
      By virtue of this Regulation, Easy Market Spa will have the right to act immediately to remove illegal activities or illegal content or to disable access to them upon obtaining actual knowledge or awareness thereof. The removal of content or the disabling of access to such content must be carried out in compliance with the fundamental rights of the recipients of the service, including the right to freedom of expression and information. Easy market Spa may obtain actual knowledge or awareness of the illegal nature of the content, through investigations and reports submitted to it by persons or entities in accordance with this Regulation, to the extent that such reports are sufficiently precise and adequately motivated to allow a diligent economic operator to reasonably identify, evaluate and, where appropriate, counteract suspected illegal content.

    • 4. PUBLIC CONTACT POINT
      Easy Market Spa designates as the single electronic contact point pursuant to Art. 11 of the Regulation with the authorities of the Member States, the Commission and the committee referred to in Article 61 for the purposes of applying the Regulation which allows them to communicate directly by electronic means, the following certified email address: amministrazione@pec.easymarketcrs.it
      Reliable informants and professionals who have a specific relationship with Easy Market Spa can also use this electronic contact point. This single electronic contact point can be addressed in the same communication languages with which Easy Market Spa offers its services to business users and consumers.

    • 5. CONTACT POINT AND RIGHTS FOR THE RECIPIENT OF THE SERVICE
      To send reports, and requests for clarification and information, the recipient of the service is required to use the following form as a single point of contact: /fi/help-center

      This form includes:
      1. space for a sufficiently reasoned explanation of why the person or entity assumes that the information in question is illegal content;
      2. a clear indication of the exact electronic location of such information, such as the exact URL address(es) and, if necessary, additional information enabling the identification of illegal content appropriate to the type of content and the specific type of storage service of information;
      3. the name and email address of the person or entity submitting the report, except in cases involving crimes relating to the sexual abuse and exploitation of minors, child pornography and grooming of minors for sexual purposes;
      4. a statement by which the person or entity submitting the report confirms its bona fide belief regarding the accuracy and completeness of the information and declarations contained therein.

      Easy Market shall, without undue delay, send confirmation of receipt of the report to such person or entity and subsequently also notify such person or entity of its decision on the information referred to in the report, providing information on the appeal options available in relation to such decision. Following the report, Easy Market Spa may decide whether or not to share this assessment and whether it intends to remove said content or disable access to such content through a specific action. The user-friendly form for reporting purposes is clearly identifiable and easy to find, located next to the general information. without unduly compromising the freedom of expression and information of the recipients of the service, in particular the right to freedom of expression and information, the right to respect for private and family life, the right to protection of personal data, the right to non-discrimination and the right to an effective remedy. The form provides mechanisms that facilitate the submission of reports containing an explanation of the reasons why the person or entity submitting the report believes that the content in question is illegal and a clear indication of the location of such content. Following the receipt of a report or acting on its own initiative, including by the exclusive use of automated means, Easy Market Spa is required to inform the recipient of its decision in a clear and easily comprehensible manner, of the reasons for the decision and the means of remedy available to challenge the decision, taking into account the negative consequences that such decisions may entail for the recipient, including with regard to the exercise of their fundamental right to freedom of expression. If the decision was adopted following receipt of a report, Easy Market Spa will be required to reveal the identity of the person or entity who submitted the report to the recipient of the service only if this information is necessary to identify the illegality of the content, for example in the case of infringement of intellectual property rights. Easy Market Spa adopts the measures and means used for the moderation of content and the handling of reports and complaints through human review, taking due account of the rights and legitimate interests of all parties involved, including the fundamental rights of service recipients. We are committed to respecting the right to freedom of expression, balancing this right with actions to remove and report illegal content to the relevant authorities, as well as the suspension and deletion of service recipients. Particular priority for reporting will be given to reliable informants pursuant to Art. 22 of the Regulation as indicated by the Digital Services Coordinator.

    • 6. JUSTIFICATION
      Easy Market Spa hereby provides all service recipients concerned service recipients with a clear and specific justification for the following restrictions imposed on the grounds that the information provided by the service recipient amounts to illegal content or is incompatible with its general terms and conditions:
      1. any restrictions on the visibility of specific information provided by the recipient of the service, including removal of content, disabling access to content or downgrading content;
      2. the suspension, termination or other limitation of cash payments;
      3. the total or partial suspension or termination of the provision of the service;
      4. the suspension or closure of the service recipient's account.

      The justification contains at least the following information:
      1. information as to whether the decision will result in the removal of the information, the disabling of access to the information, the downgrading or restriction of the visibility of the information or the suspension or termination of monetary payments in respect of the information or the imposition of other measures in relation to the information, and, where appropriate, the territorial scope of the decision and its duration;
      2. the facts and circumstances on which the decision taken is based, including, where appropriate, information as to whether the decision was taken based on a report submitted pursuant to Art. 16 of the Regulation or was based on its own voluntary investigations and, where strictly necessary, the identity of the notifier;
      3. where appropriate, information on the automated means used to take the decision, including information on whether the decision was taken on content detected or identified by automated means;
      4. if the decision concerns alleged illegal content, a reference to the legal basis invoked and an explanation of why the information is considered to be illegal content under this legal basis;
      5. if the decision is based on the alleged incompatibility of the information with the general terms and conditions of the information storage service provider, a reference to the contractual clause invoked and an explanation of why the information is considered incompatible with the clause in question;
      6. clear and easily understandable information on the remedies available to the service recipient in relation to the decision, in particular, where appropriate, through internal complaint handling procedures, out-of-court dispute resolution and judicial appeal.


    • 7. SUSPECTED OFFENCES
      If Easy Market Spa has information that leads to the suspicion that an offence has been committed, is being committed or is likely to be committed involving a threat to the life or safety of one or more individuals, it shall inform the judicial or law enforcement authorities of the Member State(s) concerned of its suspicions without delay, providing all relevant information available.

    • 8. ANNUAL REPORT
      To ensure an adequate level of transparency and assumption of responsibility, pursuant to Art. 15 of the Regulation, Easy Market Spa shall make public an annual report in an electronically readable format, in accordance with the harmonised provisions contained in the Regulation, regarding its moderation of content, including the measures taken as a result of the application and enforcement of its general terms and conditions.

    • 9. INTERNAL COMPLAINTS HANDLING AND OUT-OF-COURT PROCEDURE
      he recipient of the service will be able to submit an internal complaint free of charge to Easy Market Spa using the appropriate form /fi/help-center
      for the annulment of contested decisions within six months, to be calculated from the moment in which Easy Market Spa informed the recipient of the service of the decision. The complaint will result in possible decisions which may be:
      1. decisions on whether to remove information or disable access to or limit the visibility of such information;
      2. decisions as to whether to suspend or terminate, in whole or in part, the provision of the service to the recipients;
      3. decisions as to whether to suspend or terminate the recipients' accounts;
      4. decisions on whether to suspend, terminate or otherwise limit the ability to monetize the information provided by recipients.

    • 10. TRACEABILITY OF TRADERS
      Easy Market Spa if it allows consumers to conclude distance contracts with traders, shall ensure that the latter are able to use its online platform to advertise or offer products or services to consumers located in the Union only if, prior to allowing the use of its services for this purpose, they have received the following information, where applicable to the trader:
      1. the name, address, telephone number and email address of the trader;
      2. a copy of the trader's identification document or any other electronic identification;
      3. data relating to the trader's payment account;
      4. if the trader is registered in a business register or similar public register, the register in which he is registered and the relevant registration number or equivalent means of identification provided for in that register;
      5. a self-certification by the trader by which the latter undertakes to offer only products or services that comply with the applicable rules of Union law.
      If such traders are already using the services of Easy Market Spa which allow consumers to conclude distance contracts as of February 17, 2024, Easy Market Spa shall do its utmost to obtain the above-listed information from the traders within 12 months. Failing this, or in the event of inaccuracy, incompleteness or failure to update such information, Easy Market Spa may legitimately suspend advertising or the offer of products or services by the traders. Easy Market Spa may disclose information to third parties only if so required by applicable law, which includes any order issued by the competent authorities of the Member States or by the Commission for the performance of their tasks under the Regulation. If Art. 30 of the Regulations is applicable, Easy Market Spa shall make the information under letters a), d) and e) above available to the Recipients of the service on its online platforms in a clear, easily accessible and comprehensible manner. This information must be available at least on the online interface of the online platform where the information about the product or service appears. If Art. 30 is applicable, Easy Market Spa undertakes to make the online interface compliant from the moment of its conception so that it is designed and organised to allow traders to fulfil their obligations regarding pre-contractual information, conformity and safety of products and services in accordance within the meaning of applicable Union law. In particular for the purpose of providing information relating to the name, address, telephone number and email address of the economic operator, as defined in Article 3, point 13, of Regulation (EU) 2019/1020 and other Union legislation as well as:
      1. information necessary for the clear and unambiguous identification of the products or services promoted or offered to consumers located in the Union through the services of suppliers;
      2. any indication that identifies the trader, such as the trademark, symbol or logo; and
      3. where applicable, information relating to labelling and marking in accordance with the rules of applicable Union law on product safety and conformity.
      If Easy Market Spa becomes aware, regardless of the means used, of the fact that an illegal product or service has been offered by a trader to consumers located in the Union through its services, provided it has their contact details, or through a public notice if it does not have the latter, it will inform any consumers who have purchased the illegal product or service through its own services:
      1. that the product or service is illegal;
      2. of the identity of the trader; and
      3. of any relevant remedy.
      The obligation referred to in the first paragraph is limited to purchases of illegal products or services made in the six months preceding the moment in which the supplier became aware of the illegality.
